Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AircamX website, booking systems, and services. By booking, purchasing, or using any AircamX services, you agree to be bound by these Terms.

Services Provided

  • AircamX provides professional photography, aerial drone services, video, virtual tours, and related media services for real estate, commercial, construction, and events ("Services"). All services are subject to availability, weather conditions, airspace restrictions, and safety considerations.

Booking & Payments

  • Full payment or required deposits must be made prior to service delivery unless otherwise agreed in writing.

  • All prices are listed in USD and are subject to change without notice.

  • By completing a booking, you authorize AircamX to charge the provided payment method.

All Sales Are Final

All sales are final. Due to the nature of digital media and on-location services, no refunds are provided once a service has been rendered.

  • AircamX may offer a reshoot at no additional cost if the delivered media fails to meet agreed-upon service standards.

  • Reshoots are granted at AircamX’s discretion and must be requested within 48 hours of delivery

  • Reshoots do not apply to issues caused by weather, property condition, access limitations, staging, or changes requested after the shoot.

Cancellations & Rescheduling

  • Appointments canceled or rescheduled with at least 24 hours’ notice may be rescheduled without penalty.

  • Cancellations with less than 24 hours’ notice may result in a cancellation fee or forfeiture of payment.

  • No-shows may be charged the full service amount.

  • Weather-related delays (especially for drone services) may require rescheduling for safety and regulatory compliance.

Property Access & Preparation

  • The client is responsible for ensuring the property is accessible, ready, and safe at the scheduled time.

  • AircamX is not responsible for delays or reduced output due to lack of access, unprepared properties, or on-site restrictions.

Media Delivery & Turnaround

  • Typical turnaround times are provided as estimates and are not guaranteed.

  • Delivery timelines may vary due to volume, weather, or technical factors.

  • All media is delivered digitally unless otherwise specified.

Licensing & Usage Rights

  • Upon full payment, clients are granted a non-exclusive, non-transferable license to use the delivered media for marketing, listing, advertising, and promotional purposes related to the subject property or project.

  • Media may not be sold, transferred, sublicensed, or provided to third parties (including builders, vendors, or publications) without prior written consent from AircamX.

  • Licensing does not include ownership. AircamX retains full copyright to all media.

Marketing & Portfolio Use

By booking AircamX services, you grant AircamX the irrevocable right to use any photos, videos, or media captured for:

  • Portfolio display

  • Website, social media, and email marketing

  • Advertising, promotional, and educational materials

    No additional compensation will be provided for such use.

    Opt-Out: Requests to restrict marketing or portfolio use must be submitted in writing prior to the scheduled shoot. Requests made after service completion may not be honored.

Drone Operations & Compliance

  • All drone operations are conducted in accordance with FAA Part 107 regulations.

  • Flights are subject to airspace authorization, weather conditions, GPS interference, site safety, and no-fly zone restrictions.

  • If airspace restrictions, weather, or safety concerns prevent flight, AircamX may:

    • Offer a reschedule, or

    • Substitute ground-based imagery when appropriate

  • Drone services are not guaranteed and are dependent on regulatory approval and safety assessments.

Ground Photography Services

  • Ground photography includes interior and exterior still images captured from ground-based equipment.

  • Image composition, angles, and lighting are determined by AircamX using professional judgment.

  • AircamX is not responsible for conditions beyond our control, including clutter, staging, lighting limitations, reflections, weather, or property restrictions.

  • Minor color correction and exposure adjustments are included; advanced retouching, object removal, or virtual staging may incur additional fees.

  • Variations in appearance may occur due to lighting conditions, time of day, or property features.

3D Virtual Tours & Interior Scan Services

  • 3D services (including virtual tours, interactive walkthroughs, and interior scans) require clear access to all scan areas.

  • The client is responsible for ensuring the property is fully prepared prior to scanning. Changes requested after scanning may require a reshoot or additional fees.

  • Compatibility, display quality, and functionality of 3D tours depend on third-party platforms, devices, browsers, and internet connection.

  • AircamX is not responsible for platform limitations, outages, compression, or removal by MLS, Zillow, or other third-party services.

  • Measured dimensions, floor plans, or spatial representations generated from 3D scans are approximate and should not be relied upon as exact measurements.

Limitation of Liability

AircamX shall not be liable for:

  • Listing performance, buyer interest, or sales outcomes

  • MLS, Zillow, or third-party platform rejections, compression, cropping, or removal of media

  • Weather conditions, lighting variations, or environmental changes

  • Indirect, incidental, special, or consequential damages

  • Loss of business, listings, profits, or anticipated revenue

    Total liability shall not exceed the total amount paid for the specific service giving rise to the claim.

Indemnification

You agree to indemnify, defend, and hold harmless AircamX, its owners, operators, and contractors from any claims, damages, losses, liabilities, or expenses (including attorney fees) arising from:

  • Use, misuse, or modification of delivered media

  • Property access issues, unsafe conditions, or on-site restrictions

  • Violations of HOA rules, community guidelines, or local regulations

  • Breach of these Terms of Service

Description of SMS Use Cases

AirCamX may send SMS messages for conversational and informational purposes, including but not limited to:

  • Appointment confirmations and reminders

  • Scheduling updates or changes

  • Service notifications related to booked photography or media services

  • Follow-up messages regarding inquiries or completed services

  • Important account or service-related information

  • Limited promotional messages or special offers (only when consent is provided)

Message frequency may vary based on your interaction with our services.

Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. Once you opt out, you will no longer receive SMS communications unless you re-subscribe by replying START or submitting a new opt-in request.

Message & Data Rates Disclosure

Message and data rates may apply depending on your mobile carrier and service plan. AirCamX is not responsible for any charges incurred from your mobile provider.

Age Restriction

By opting into SMS communications, you confirm that you are at least 18 years of age or have the permission of a parent or legal guardian to receive text messages.

Privacy & Data Protection

Your phone number and SMS consent will never be sold, rented, or shared with third parties for marketing purposes. Your information is used solely to support the services and communications you request from AirCamX.

Changes to SMS Terms

AirCamX reserves the right to modify or update these SMS Terms at any time. Any changes will be posted on this page with an updated effective date.

Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

AircamX reserves the right to update or modify these Terms at any time. Continued use of services after changes are posted constitutes acceptance of the revised Terms.
